Welcome to The FUNdamental Learning Lab. These Terms and Conditions govern your use of www.FUNdamentalLearningLab.com, our online store, free resources, digital products, communications, and related services.
The website and its resources are operated by The FUNdamental Learning Lab, doing business as The FUNdamental Learning Lab. In these Terms, “we,” “us,” and “our” refer to The FUNdamental Learning Lab. “You” and “your” refer to the person accessing the website, downloading a resource, or making a purchase.
By using this website, submitting a form, downloading a free resource, or purchasing a product, you agree to these Terms. Please do not use the website or purchase our resources if you do not agree with them.
1. Intended Audience
This website is intended for adults, including parents, caregivers, homeschool families, teachers, tutors, interventionists, and representatives of schools, churches, daycares, learning centers, and other educational programs.
Our resources may be used with children, but purchases, account activity, form submissions, and email subscriptions should be completed by an adult who is at least 18 years old or has the legal authority to enter into an agreement.
Children under 13 should not submit personal information through this website.
2. Educational Purpose
The FUNdamental Learning Lab provides supplemental educational resources designed to support foundational learning.
Our resources are not:
A replacement for professional educational instruction
A complete curriculum unless specifically described as one
A diagnostic assessment
Medical, psychological, therapeutic, or legal advice
A guarantee of school readiness, placement, grades, test results, or academic performance
Children develop at different rates. Customers are responsible for determining whether a resource is appropriate for a particular learner, educational setting, curriculum, school system, or state requirement.
References to standards or educational expectations are provided for informational purposes. Unless expressly stated otherwise, our resources are not created, sponsored, approved, or endorsed by any state department of education, school district, testing organization, or government agency.
3. Product Descriptions
We make reasonable efforts to describe each resource accurately and to display representative previews.
Product colors and appearance may vary depending on:
Device settings
Screen resolution
Printer type
Printer settings
Paper and ink
Software used to open the file
Customers are responsible for reviewing the product description, page count, grade level, file format, license information, and printing requirements before purchasing.
4. Digital Products
Unless a listing clearly states otherwise, products sold through our website are digital products.
No physical item will be shipped for a digital purchase.
After successful payment, the purchaser will receive access to the applicable file or download instructions. Customers are responsible for:
Providing a correct email address
Downloading and saving purchased files
Maintaining access to compatible software and devices
Keeping personal backup copies
Contacting us promptly if a file cannot be accessed
We may update, correct, replace, or discontinue a product at any time. A purchase does not guarantee lifetime hosting or unlimited future downloads unless the product listing specifically promises that access.
5. Payments, Prices, and Taxes
Prices are displayed in the currency shown at checkout and may change without notice.
Payments may be processed by third-party payment providers such as [Stripe, or other provider]. We generally do not receive or store your complete credit-card number.
You agree to provide accurate billing and contact information and confirm that you are authorized to use the selected payment method.
Applicable taxes may be calculated and collected based on the transaction, customer location, platform, and legal requirements.
Discounts, promotional codes, and special offers:

May contain additional conditions
Cannot ordinarily be applied retroactively
Have no cash value
May not be combined unless expressly permitted
6. License to Use Purchased Resources
Your purchase provides a limited, nonexclusive, nontransferable, revocable license to use the resource. You are purchasing permission to use the content—not ownership of its copyright or intellectual property.
Unless a product listing provides a different license, one purchase permits use by:

You may:

Multiple teachers
Multiple tutors
Multiple classrooms
Multiple locations
A school, district, daycare, church, learning center, nonprofit, or other organization
Employees or contractors other than the original purchaser
Contact us for additional-user, school, organization, or site-license options.
7. Free Resources
Free checklists, samples, activities, and other complimentary resources remain the intellectual property of The FUNdamental Learning Lab.
Unless stated otherwise, free resources are subject to the same personal, household, or single-educator license as paid products.
Receiving a resource for free does not give permission to sell it, redistribute it, upload it publicly, or include it in another product.
You may share the link to the official signup or download page so others can obtain their own authorized copy.
8. Intellectual Property
The website and its original content—including text, product names, descriptions, designs, illustrations, logos, graphics, photographs, videos, resource pages, downloadable files, and branding—are owned by or licensed to The FUNdamental Learning Lab and are protected by applicable intellectual-property laws.
“The FUNdamental Learning Lab,” its logo, taglines, and associated branding may not be used in a way that suggests sponsorship, affiliation, endorsement, or ownership without written permission.
Nothing in these Terms transfers ownership of our intellectual property to you.
9. Reviews, Comments, and Submitted Content
You may have opportunities to submit reviews, feedback, photographs, testimonials, questions, or other content.
You agree not to submit content that:
Is false, misleading, unlawful, threatening, or defamatory
Violates another person’s privacy or intellectual-property rights
Contains confidential student information
Identifies a child without appropriate permission
Contains malware, spam, or unauthorized advertising
You retain ownership of original content you submit. However, when you voluntarily submit a review or testimonial, you grant us a nonexclusive, royalty-free license to display, reproduce, and use it for business and marketing purposes, subject to applicable law.
We will not intentionally publish a child’s full name, private educational record, or identifying photograph without appropriate authorization.
10. Email Communications
When you request a free resource or join our mailing list, you may receive the requested resource as well as educational tips, brand updates, product announcements, and promotional messages.
You may unsubscribe from marketing emails at any time by using the unsubscribe link included in an email. Unsubscribing from marketing messages will not necessarily stop transactional communications related to purchases, downloads, support requests, or account activity.
11. Third-Party Services and Links
Our website may use or link to third-party services, including:
Website hosting and ecommerce providers
Payment processors
Email-marketing providers
Analytics providers
Social-media platforms

Other marketplaces or educational websites
We do not control the availability, security, content, or policies of third-party services. Your use of those services may be governed by their own terms, privacy policies, refund policies, and marketplace rules.
A link to a third-party website does not necessarily indicate endorsement.
12. Marketplace Purchases
Purchases made through Etsy, Teachers Pay Teachers, or another third-party marketplace are also governed by that marketplace’s terms, payment procedures, licensing requirements, dispute process, and refund rules.
Where a marketplace policy conflicts with these Terms for a transaction completed on that marketplace, the marketplace’s mandatory requirements will control to the extent necessary.
13. Prohibited Website Use
You may not use the website to:
Violate any law
Interfere with website security or operation
Attempt unauthorized access
Introduce malicious software
Collect information about other users
Copy or scrape content for commercial use
Impersonate another person or business

Circumvent licensing or access restrictions
Use automated systems to extract, reproduce, or redistribute our content without permission
14. Availability and Technical Issues
We aim to keep the website and resources accessible, but uninterrupted or error-free operation cannot be guaranteed.
We may temporarily suspend access to perform maintenance, resolve technical problems, improve the website, protect security, or comply with legal requirements.
We are not responsible for delays or failures caused by circumstances outside our reasonable control, including hosting outages, internet-service failures, payment-provider interruptions, device incompatibility, or third-party-platform issues.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the website and resources are provided on an “as is” and “as available” basis.
We do not guarantee that:
Every resource will be appropriate for every learner
A child will achieve a particular educational outcome
The website will always be available or error-free
Every file will function with every device, program, or printer
Information will remain current after publication
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
